Terms & Conditions


1. General

This website is New Zealand owned and operated by The Exotic Grocer Limited

  •  Customer” Means the person who purchases fruit using your login
  • The Exotic Grocer Ltd” Means or The Exotic Grocer
  • GST” Means Goods & Services Tax chargeable in accordance with the Goods & Services Tax Act 1985
  • Login” Means a customer’s personal email address and password used to access The Exotic Grocer
  •  Fruit” Means products for sale on The Exotic Grocer website

By using The Exotic Grocer you agree that you have read, understood and accepted these terms and conditions. All Fruit and other products supplied by The Exotic Grocer will be in accordance with these terms and conditions and The Exotic Grocer has the right to change these terms and conditions from time to time.

The Exotic Grocer has the discretion to decline any order placed or cancel any order for any reason.

Customers are liable for every order made under their login.

The Exotic Grocer takes steps to ensure the information provided on its website is correct, however there is no warranty in this regard and The Exotic Grocer will not be liable for any error or omission. All photos show a representation of appearance of the product, but there is likely to be variations within a variety.


2. Price

The customer will pay The Exotic Grocer for the fruit ordered at the price displayed on the website at the time the order is submitted together with all shipping costs. (Nothing on our site is priced at $0.00. Anything priced at $0.00 is not valid).

In the event the customer has selected an incorrect shipping option, The Exotic Grocer reserves the right to refuse or cancel the order, or to charge for any additional shipping costs. The customer will be notified if there is any additional delivery charge for their order.

The prices of fruit and shipping costs are in New Zealand currency and are inclusive of GST.

If The Exotic Grocer is unable to supply the fruit ordered, The Exotic Grocer will refund the Customer’s payment.

3. Product Quality

The customer acknowledges The Exotic Grocer is selling perishable goods. The Exotic Grocer will, at its discretion, replace any damaged fruit or provide a refund provided the customer lets The Exotic Grocer know within 48 hours of receiving the damaged fruit. If requested by The Exotic Grocer you need to provide a photo of damaged fruit before any refund or replacement.

The Exotic Grocer will not be liable for damage to fruit as a result of it being incorrectly stored or handled after delivery.

4. Payment

Customers must pay for the fruit purchased either by internet banking or by credit card before their order will be dispatched.

The customer is liable for all costs associated with debt collection.  The Exotic Grocer does not keep on record any customers credit card details.  “Stripe” is the company The Exotic Grocer uses for processing all credit card transactions securely. 

5. Delivery

The Exotic Grocer reserves the right to withhold delivery of any product for any reason whatsoever.

Deliveries will be made to the address and location the customer has identified on the order and once left at the specified address the fruit will be deemed to be delivered.

The customer will ensure The Exotic Grocer or its agent is able to deliver where instructed by the Customer.

The Exotic Grocer endeavours to dispatch all orders within five working days. If a customer has not received an order within seven days of having placed the order, they are required to contact The Exotic Grocer. In the event the customer receives an incorrect order the customer is required to notify The Exotic Grocer within 24 hours of receipt and failure to do so will deem acceptance of the fruit delivered by The Exotic Grocer. If the customer contacts The Exotic Grocer within 24 hours The Exotic Grocer will arrange for replacement of the correct fruit if it is available.

6. Liability and indemnity, product liability & liability of The Exotic Grocer

The Exotic Grocer is not liable for any loss, damage or injury arising directly or indirectly from any fruit. The Exotic Grocer is not liable for any consequential injury or loss of any kind arising from the customer’s use of The Exotic Grocer or the delivery or failure to deliver fruit.

7. Indemnity

The customer agrees to indemnify The Exotic Grocer against all liabilities, losses, claims and expenses arising directly or indirectly out of the customer’s use of the The Exotic Grocer site or delivery or failure to deliver any product.

8. Use of cookies by The Exotic Grocer

Google Analytics
These cookies are used to collect information about how visitors use our site. We use the information to compile reports and to help us improve the site. The cookies collect information in an anonymous form, including the number of visitors to the site, where the visitors have come to the site from and the pages they visited.


 9. Guarantee

If the customer is not completely satisfied with the quality of The Exotic Grocer fruit after delivery, The Exotic Grocer will provide a replacement or a refund.

10. Refunds

The Exotic Grocer does not refund you if you change your mind.
